Prop firms without a consistency rule
Most prop firms don't have one rule for everyone: the same firm can apply a consistency rule on one plan and not on another, or in the evaluation but not on payouts. Here is every plan of the 21 futures and forex firms we review, checked against each firm's own rules.

Futures prop firms without a consistency rule
Futures firms mostly use the rule in one stage and drop it in the other. Pick the plan by where a big day is most likely to hurt you: in the evaluation it only delays passing, while on a funded account it holds up your payout.

Forex prop firms without a consistency rule
Forex firms rarely use the rule in their challenges. Where they do have one, it is usually attached to faster or on-demand payouts, so the standard payout schedule is the way to avoid it.

Instant funding without a consistency rule
Instant accounts skip the evaluation, so firms lean on the consistency rule to filter out traders who make one lucky trade. Of the instant accounts we track, FundedNext Stellar Instant is the only one without it:
- Tradeify Lightning Funded, first payout: 20% best-day rule
- Tradeify Lightning Funded, second payout: 25% best-day rule
- Tradeify Lightning Funded, later payouts: 30% best-day rule
- Top One Futures Instant Sim Funded: 20% best-day rule
- FuturesElite Instant, first payout: 20% best-day rule
- FuturesElite Instant, second payout: 25% best-day rule
- FuturesElite Instant, later payouts: 30% best-day rule
- Goat Funded Futures Instant Classic: 20% best-day rule
- FTMO Instant Account: 30% best-day rule
- FundedNext Stellar Instant: no consistency rule
No consistency rule doesn't mean you can withdraw everything
Firms that drop the rule usually limit payouts another way. A few examples from the plans above:
- E8 Pro has no consistency rule, but counts at most 2% profit per day toward a payout, so a 6% day still counts as 2%.
- FundingPips has no rule on weekly and bi-weekly rewards, but weekly pays a 60% split and bi-weekly 80%; the 100% on-demand option brings back a 35% rule.
- TradeDay Quick Pay has no consistency rule on payouts, but pays 50/50 until the account has more than $4,000 profit.
- Apex has no rule in the evaluation, so you can pass in a day, but each Performance Account payout needs your best day under 50% of the profit since your last payout.
Before you choose a plan only for the missing rule, compare its drawdown type, daily loss limit, payout caps and minimum winning days. Want to know if your own trading passes a rule? Try the consistency calculator, or read how the consistency rule works.
How we checked
Every rule on this page comes from the firm's official help center or rules page, listed in the sources of each review, and was last checked on October 26, 2026 or earlier. The same data powers our consistency calculator and our prop firm statistics. Firms change these rules often; if you spot a change, tell us and we will update the page.
Frequently asked questions
Which prop firms have no consistency rule?+
Among the 21 firms we review, these routes have no consistency rule from evaluation to payout: FundedNext Futures Rapid Daily; Phidias Propfirm Express to Live; FTMO 2-Step; The5ers High Stakes; FundingPips 2-Step with weekly or bi-weekly rewards; E8 Markets E8 Pro; FundedNext 2-Step or 1-Step with standard reward cycles; Alpha Capital Group Alpha Pro with bi-weekly payouts; FundedNext Stellar Instant (no evaluation). Many other firms drop the rule at one stage only; see the tables on this page.
Does Apex Trader Funding have a consistency rule?+
No consistency rule in the evaluation. In the Performance Account, to request a payout your largest profitable day must be less than 50% of net profit since the last approved payout (best day ÷ 0.5 = profit needed).
Does Topstep have a consistency rule?+
In the Trading Combine your best day must stay below 55% of the profit target; if it goes higher, the target rises to best day ÷ 0.55. On the XFA Consistency payout path, your largest day must be 40% or less of net profit since the last payout.
Does FTMO have a consistency rule?+
None on the 2-Step. On the 1-Step, your best day may be at most 50% of total profit, both to pass and before each reward; on the Instant Account the limit is 30%. Going over is not a breach; you keep trading until the share falls.
Do instant funding accounts have a consistency rule?+
Usually yes. Of the instant accounts we track, FundedNext Stellar Instant has no consistency rule; the others cap your best day at 20% to 30% of profit, because there is no evaluation to filter out one-day gamblers.
Is a prop firm without a consistency rule better?+
Not automatically. Firms that drop the rule usually balance it with something else: a daily loss limit, a cap on how much profit counts per day or per payout, a minimum number of winning days, a lower profit split or slower payouts. It suits traders whose profits come in a few big days. If your days are fairly even, a consistency rule rarely gets in the way, so compare price, drawdown and payout terms first.
